A shiver ran through me as I watched James Comey’s clumsy dance around the edges of why Hillary was guilty of selling out her country, yet would not be prosecuted. Could that day, July the 5th, two days into America’s 241st year be the end of the republic established in 1788? Did we witness THE historic moment of the 21st century?

As opposed to authoritarian regimes in which the moment of their deaths is known exactly by the date and time their despots pass on into hell, what of republics? When do republics die?

One of the most famous ancient republics, Sparta, can date its end when it was conquered by the most famous ancient republic, Rome, in 146 BC. What of the Roman republic itself? Did it expire when Caesar crossed the Rubicon with his legions in 49 BC? If not, then it certainly passed by 27 BC when the Senate granted Octavian the title of Augustus and Princeps. As described by Tacitus, subsequent emperors murdered men they suspected of having the slightest tendency toward free government. How many people do you know who died under mysterious circumstances? Bill and Hillary Clinton know lots of them.

Republics have been described as empires of laws. For decades, I just accepted as truth that our republic lived as long as congress sends bills to be signed into law by the president. My view was refined upon reading the radical republican John Locke, who believed republics perish the moment the legislative power is usurped, either by making statutes outside the limits of their charters, or when lawmaking is assigned to a man or institution outside of the legislative.

If that is true, then we’ve been slogging along in a dead republic since the days of FDR when scotus gave its imprimatur to congressional and executive branch powers far outside the limits of the social compact known as our Constitution. Obama rewrites Obamacare to suit his fancy; the EPA and other various agencies make, enforce, and adjudicate regulations with force of law. Even the Leftist Jonathan Turley of George Washington Law School recently warned a congressional committee that republican lawmaking is fast slipping out of the hands of congress.

Against this background of lawmaking outside the lawmaking branch, and thanks to James Comey’s Hillary ruling of July the 5th, the inner workings of our future and despotic government will increasingly take on the characteristics of the old Soviet Union. The poor people of the USSR knew only that which the politburo let them know. Sure, there was a fake legislature in something called the Supreme Soviet, but real decisions were made by a central committee and politburo that called the shots for a nation of hundreds of millions. Government in all authoritarian regimes is conducted in the dark.

With her get-out-of-jail-free card from Comey, Hillary is not only home-free, but future secretaries of state, other cabinet secretaries, and their assistants (like Huma Abedin and Cheryl Mills) are also green-lighted to transact public business in the dark. Like the teenager who gets away without punishment from his parents, our government unfortunately operates far more on the basis of precedent than on the law.

Should the unspeakable happen this coming November, executive branch functions legal and illegal, performed by a naturally reclusive, fearful, vengeful, and psycho Hillary will be in the dark, and completely shut off from any semblance of open, republican, free government view. Like serfs in any authoritarian state, we’ll never know what hits us until it happens. A Hillary congress might not even bother with its embarrassing Kabuki show hearings that typified the Obama years in which various secretaries and high officials committed perjury without punishment.

While I don’t know the exact date, I am certain that the soul of our republic, that of limited lawmaking by a congress of the people and states, no longer exists. One can argue that our republic died in 1913 upon ratification of the 17th Amendment, or during the FDR years, with the advent of a “pen and a phone” president, or on July 5th. No matter exactly when, we know it is gone.

We also know what we must do.

    The author is right to question whether our republic will survive under the present circumstances. I do disagree with his assessment of Hillary getting off scot-free. It’s obvious Comey feels Hillary is at best ignorant and at worst incompetent dealing with setting up her private server and handling confidential info. His presser on the FBI investigation and his questioning by the Republicans at Thursday’s hearing made it appear that Comey overlooked obvious actions on Hillary’s and her staffs part to obfuscate their attempts at keeping Hillary’s emails secret and away from FOIA requests. In the process, she risked our national security by not treating confidential documents properly. It’s now up to Trump and the Republican Part (the party of stupid) to highlight what Comey found thru ads, print media and speeches.

    I have taken Mr. Dodworth’s advice and joined the Convention of States, signed the petition, volunteered and am making monthly donations. It’s our only hope of reining in a Federal Govt. that’s way too powerful and the politicians who want to rule us.

    Great article Rodney…And so the corruption continues at our top law enforcement levels. Folks it is not just time for a Convention of States, it is “past” time!!! One by one our rights are being taken away by executive order, administrative acts & judicial overreach. The States created the Federal government and its now time to take the power back.     We’ve bumped up against a plethora of constitutional crises for years now. The latest one is particularly galling, but remember they each have been so at the time we first encountered them.     I agree this republic is in dire straits and is in the ever tightening grips of death; however, if “We the People” band together we can throw off the grip of death and reassert life in our Nation. I go to the “Pledge of Allegiance” and it is right their how to save this Great Nation—-“I Pledge Allegiance to the flag of the United States of America and to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all.” If we all stand together elect Constitutional Government officials at the local state and federal levels and pass the Convention of States Project Resolution in thirty-four States we will reinvigorate this nation and it can happen much quicker than the Liberals can deal with.     As the idea of equal-under-the-law continues to erode, along with the social compact formed by our founding charters, it does seem the active governing-theory is that of a despotic political oligarchy. On this trajectory we would indeed eventually find ourselves outside the state of society and in a state of nature, at war with a tyrannical government. However, we have yet to exercise the powers granted under Article V of the constitution, which enable the states to insist on a return to the principles that our nation was founded on. The states can do this by calling an amending convention. This process is worth trying, and it was written into the constitution for just the kind of situation we have now, a tyrannical and irresponsible central government.       If just ten percent of the American people understood and shouted out this Lockean concept, we’d never have to fear government.
